Over the course of more than 20 years of practice, John has developed a wealth of experience, having worked at boutique employment law firms and Am Law 100 firms, and he writes and speaks frequently on various employment law issues. John is experienced in almost every aspect of California labor and employment law, including:

  • Harassment and discrimination litigation

  • Wage and hour class and collective actions

  • Advice and counseling (including the development and rollout of personnel and wage and hour policies)

John brings a “live-in-the-client’s-shoes” mentality to every matter he handles, whether it’s tailoring the defense of a wage and hour class action to manage litigation costs strategically, drafting internal client documents with an eye toward how they might look before a jury, or recommending policy changes to reduce potential long term exposure. John takes particular pride in the work he does at the pre-litigation stage, where he often finds himself endeavoring to persuade the opposition that litigation against our client will not be worth their time or effort.

John is an active member of the firm’s Artificial Intelligence practice group and writes and speaks frequently regarding AI issues.

John earned his bachelor’s degree from Vanderbilt University and his law degree from the UCLA School of Law.

Experience

Obtained a favorable result, following an eight-day jury trial in Contra Costa County, Cal., for the defendant in a case centering on alleged unreimbursed business expenses and a purported conspiracy to use the plaintiff's confidential information to raid his employees, which the plaintiff claimed had resulted in the wholesale destruction of his business. The jury found for the defendant on the conspiracy claim and determined that the plaintiff was not an employee and was therefore ineligible to recover business expenses for the bulk of the time period at issue. While the plaintiff presented expert witness testimony at trial suggesting that his damages exceeded $20 million, the jury awarded him just slightly over $30,000.


Developed client policy on the use of generative AI in the workplace.


Advised fine dining group in its development and rollout of COVID-19 protocols and policies, including a mandatory vaccination policy for restaurant staff.


Won summary judgment on behalf of a health care employer in a sexual harassment, disability discrimination, and wrongful termination claim in which an employee who had made numerous complaints about alleged harassment by her co-workers was terminated immediately after returning from an extended leave. Argued successfully that, while it was undisputed that the plaintiff had complained about the way others were treating her, the evidence did not establish any connection between the alleged harassment and her sex or any membership in a protected class, or any connection between her complaints or purported disability and her ultimate termination.


Resolved, prior to litigation, a claim that a former employee was allegedly owed in excess of one million dollars in unpaid commissions, marketing expenses and other damages after securing admissions from the potential plaintiff that he had improperly billed our client for services not actually performed.


Successfully demurred, on three occasions, to a claim that a plaintiff had allegedly been discriminated against due to a perception he had voted for a particular candidate in the 2016 presidential election, ultimately resulting the withdrawal of the claim.


Represented Aspen Capital Group, LLC, a private equity firm, in its role as lead investor in the $25 million Series B fundraising round of CLARA analytics, Inc., a provider of artificial intelligence technology in the commercial insurance industry. This transaction drew on the experience of the firm's corporate, tax, intellectual property, and labor and employment attorneys.


Represented a media services management company in its sale to a digital media distribution and software company. This transaction drew on the experience of the firm's corporate, tax, labor and employment, and employee benefits and executive compensation attorneys.
